37. The prohibition set forth in section 128.6 does not apply to a person who carries on an activity involving the construction or improvement of a forest road referred to in the second paragraph of section 31 of the Forest Act (chapter F-4.1), where the person carries on the activity in compliance with section 8, except in the habitat of a threatened or vulnerable wildlife species.
